1. Introduction and Acceptance
Welcome to FinalVault ("we," "us," "our"), operated by FinalVault LTD, a company registered in Scotland (Company Number: SC856871). These Terms of Service ("Terms") govern your use of our digital inheritance and document storage platform accessible at finalvault.co.uk ("Service").
By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.
IMPORTANT: Our Service helps families manage digital inheritance and document storage. These Terms contain important provisions regarding data access after death, beneficiary rights, and limitations of liability that you should read carefully.
2. Definitions
- "Account" means your FinalVault user account
- "Account Holder" means the primary user who creates and maintains the account
- "Beneficiaries" means individuals designated by the Account Holder to receive access to stored information
- "Digital Assets" means passwords, documents, files, and other digital information stored in your account
- "Executor" means the person legally appointed to administer the Account Holder's estate
- “Key Holder” to be used interchangeably with Beneficiaries to mean the same thing
- "Professional Partner" means solicitors, financial advisors, or other professionals who refer clients to our Service
- “Vault” means a digital repository containing your Digital Assets
3. Service Description
FinalVault provides a secure digital vault for storing:
- Important documents and files
- Password and login information
- Digital asset inventories
- Instructions for beneficiaries
- Contact information for professional advisors
Our Service includes features for designated beneficiaries to access stored information following proper verification procedures after the Account Holder's death or incapacity.
4. Eligibility and Account Registration
4.1 Eligibility
You must be at least 18 years old and have the legal capacity to form binding contracts under UK law to use our Service.
4.2 Account Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- Each person may maintain only one active account
4.3 Account Verification
We may require identity verification before providing access to certain features or information, particularly for beneficiary access requests.
5. Subscription Plans and Payment Terms
5.1 Subscription Plans
We offer multiple subscription tiers:
- Standard Plan: £89 annually
- Complete Plan: £149 annually
- Premium Plan: £249 annually
5.2 Payment Terms
- Subscriptions are billed annually in advance
- All fees are non-refundable except as required by law
- We may change pricing with 30 days' notice to existing subscribers
- Failed payments may result in account suspension or termination
5.3 Free Trial
- New users may receive a 14-day free trial
- Trials automatically convert to paid subscriptions unless cancelled
5.4 Automatic Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before renewal. You may cancel through your account settings or by contacting support.
6. Data Storage and Security
6.1 Data Location
All data is stored on secure servers located within the United Kingdom and is subject to UK data protection laws.
6.2 Security Measures
We implement industry-standard security measures including:
- AES-256 encryption for all stored data
- Multi-factor authentication requirements

- Active account data is retained indefinitely while subscriptions remain current
- Cancelled account data is retained for 90 days before deletion

7. Permitted Use and Restrictions

You may use our Service to:

- Designate beneficiaries for information access

7.2 Prohibited Use
You may not:
- Store illegal, harmful, or offensive content
- Share your account credentials with unauthorized individuals

- Use the Service for commercial purposes without authorization
- Upload malware, viruses, or malicious code
- Violate any applicable laws or regulations
7.3 Content Standards
All stored content must comply with UK law and must not:

8. Death and Incapacity Procedures
8.1 Beneficiary Access
Designated beneficiaries may request access to stored information by:
- Entering their allocated keys into the Vault portal
- All keys allocated must be entered to open the Vault
- The Vault will be made available to the designated beneficiaries
8.2 Executor Rights
Court-appointed executors may override beneficiary designations upon providing:
- Valid grant of probate or letters of administration
- Proof of identity and legal authority
- Compliance with our executor verification process
8.3 Incapacity Procedures
For Account Holder incapacity:
- Medical certification of incapacity may be required
- Power of attorney documentation must be provided
- Emergency contacts may be consulted for verification
- Temporary access may be granted pending full verification
8.4 Disputed Access
In cases of disputed beneficiary claims or executor challenges:
- We may freeze account access pending legal resolution
- Court orders will be honored and implemented
- Legal fees incurred may be charged to the estate
- Final decisions rest with competent UK courts
9. Professional Partner Program
9.1 Partner Referrals
Professional partners (solicitors, financial advisors) may:
- Refer clients to our Service
- Receive referral fees for successful conversions
- Access limited account information with client consent
- Participate in co-marketing activities
9.2 Partner Obligations
Professional partners must:
- Comply with their professional regulatory requirements
- Maintain client confidentiality
- Provide accurate referral information
- Honor our partnership agreement terms
10. Intellectual Property Rights

- We are not responsible for disputes between beneficiaries or executors
12.4 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, cyber attacks, or government actions.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service
- Your breach of these Terms
- Your violation of any laws or third-party rights
- Content you store or share through our Service
14. Termination
14.1 Termination by You
You may terminate your account at any time through your account settings or by contacting support. Termination does not entitle you to refunds of prepaid fees.

We may terminate or suspend your account immediately if you:

14.3 Effect of Termination
Upon termination:
